Dating violence is defined as “violence between individuals who have or have had a continuing and significant relationship of a romantic or intimate nature.” In determining whether someone is in such a relationship, the court looks at the following factors:
- A dating relationship must have existed within the past 6 months;
- The nature of the relationship must have been characterized by the expectation of affection or sexual involvement between the parties; and
- The frequency and type of interaction between the persons involved in the relationship must have included that the persons have been involved over time and on a continuous basis during the course of the relationship.
On the other hand, if you have a child in common, if you are married or were ever married, if you are related by blood or marriage and ever lived together or if you are currently living together, you qualify for a domestic violence injunction. As can be seen, the domestic violence injunction subsumes a large portion of those cases that would otherwise qualify as a dating violence injunction.
While not common, sometimes a dating violence injunction is appropriate. As attorneys, we most often see dating violence injunction between college students, who are likely to be dating, but not living together and not having any children in common.
